WhatsApp Scores Big Win at EU Court to Contest €225M Irish Privacy Fine

WhatsApp has secured a crucial endorsement from the Court of Justice of the European Union (CJEU) that lets it challenge a hefty privacy fine originally set at €225 million ($268 million) by Ireland's Data Protection Commission (DPC). This ruling could open doors for other tech firms tangled in similar disputes over European privacy rules.

The saga began when Ireland's DPC, acting as the lead regulator for many U.S. tech giants headquartered in the country, slapped WhatsApp with the fine after examining complaints over its personal data handling. The fine grew in size after the European Data Protection Board (EDPB) got involved, signaling a firm stance on enforcement.

Collecting on GDPR fines has proven tricky. Despite imposing over €4 billion in penalties since 2020, the Irish regulator has recovered just €17.5 million due to drawn-out legal battles, most involving appeals and EDPB interventions. WhatsApp's case underscores this trend.

Initially, WhatsApp's attempt to appeal the increased fine ran aground at a lower court, which ruled the company lacked legal standing because the EDPB's decision was addressed to the Irish watchdog rather than WhatsApp itself.

That took a sharp turn when the CJEU stepped in, overturning this procedural hurdle. The Luxembourg-based court clarified that the EDPB's ruling was directly relevant to WhatsApp's legal position and could be contested, directing the lower court to reassess the matter on substance rather than formalities.

A WhatsApp representative hailed the judgment, noting it reinforces the ability of companies to hold the EDPB accountable by judicial review. This could breathe new life into various appeals stalled across Europe.

More clarity on the calculation and legitimacy of WhatsApp's penalty could ripple across other ongoing disputes between tech giants and regulators. The case bears watching, as it might reshape how GDPR enforcement plays out, particularly when contrasting national regulators and European authorities collide.

The legal showdown is formally recorded as C-97/23P WhatsApp Ireland v EDPB, and the telecom and tech spheres will no doubt keep an eye on how this unfolds.
